Subject: Issue of Compendium of instructions on reservation for ex-servicemen. 

This Department has been in the process of issuance of a compendium on instruction on reservation, concessions and relaxations for Ex-servicemen in Central Government Services. In this regard, the Department of Ex-servicemen Welfare may refer to their O.M. No. 28(66)/2013/D (Res.I) dated 17.07.2013 and 18.09.2013. 

The compendium has now been finalized covering various notifications and Office Memorandum issued on reservation, concessions and relaxations for Ex-servicemen in Central Government Services. A copy of Compendium is enclosed.

Sub: – Clarification on reckoning of period of “Dies non” while & granting ACP / MACP to officials.
The issue of counting the period of “Dies non” for the purpose of ACP / MACP was raised in JCM (DC). The issue was examined in consultation with DoPT. The Nodal Department has clarified the issue vide DOFF ID NO. 78961/13/CR dated 14.11.13 as below:-
“Regular service for the purpose of grant of financial upgradations under MACPS includes all period spent, on deputation/foreign service, study leave and all other kind of leave, duly sanctioned by the competent authority. In terms of Government of India decisions relating to ” Treatment of willful absence from duty given under Rule 25 (leave) of CCS (Leave) Wes, 1973, the period of absence not covered by grant of leave shall have to be treated as “dies non” for all purpose, viz increment, leave and pension. Though the.period of dies non does not constitute break in service, but only the day (s) treated as dies non are not counted as duty for any purpose. Dies non is only a concession for permitting the beneficiary thereof to have subsequent service in continuation of the period of service before the beneficiary proceeded on unauthorized. absence.
“Accordingly, it is clarified that dies non period will not be counted as regular service for the purpose of grant of financial upgradation under ACP/MACP Schemes”.

Subject: - Stepping up of pay of the promotee senior with direct recruited junior appointed on or after 01.01.2006

This is regarding stepping of pay of promote senior with reference to direct recruit junior appointed after 01.01.2006.

2. The issue was examined in this office and referred to Ministry of Finance for clarification. Ministry of Finance Department of Expenditure Legal Cell vide U.O. No. 18/28/2010-Legal dated 29.12.2010 has clarified that the stepping up of pay of the promote senior with direct recruited junior appointed on or after 01.01.2006 may be agreed to subject to fulfillment of the following conditions: -

(a) Stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the directly recruited junior provided they belong to the same seniority list for all purposes.

(b) Further, government servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 01.01.2006 as laid down in Section II of part A of First Schedule to the CCS (RP) Rules, 2008, if their cadre does not have an element of direct recruitment or in cases where no junior is drawing basic pay higher than them.


(c) Stepping up of pay of the seniors in accordance with the present advice of this Department shall not be applicable in cases where direct recruits have been granted advance increment at the time of recruitment.

3. The issues prevailing in the Circle may be decided as per above clarifications.

SUB: FIXATION OF PAY OF RE-EMPLOYED PENSIONERS-TREATMENT OF MILITARY SERVICE PAY.






The undersigned is directed to refer to the orders issued vide O.M. dated 5.4.2010 on fixation of pay of re-employed pensioners. These orders inter-alia lay down that on re-employment in civilian organizations, Military Service Pay shall not be admissible. However, the benefit of MSP given to all retired Defence Forces officers/personnel by reckoning it at the time of calculation of their pension (notionally in the case of pre-1.1.2006 pensioners) should not be withdrawn. Accordingly while the pension of such re-employed pensioners will include the element of MSP, they will not be granted MSP while working in civilian organizations.






In the instructions issued by the Ministry of Defence vide their letter No. 1/69/2008/D (Pay/Service) dated 24th July 2009, Pre-retirement pay has been defined as under:






(i) In respect of re-employment taking place on/or 1.1.2006 pre-retirement pay for those who retired after 1.1.2006 means the pay in the pay band plus grade pay but inclusive of Non-Practicing Allowance(NPA) if any, last drawn before retirement.


(ii) In case of officers who retired before1.1.2006 and also those who retired after 1.1.2006 in the pre-revised pay scales without opting for the revised pay scales promulgated on or after 1.1.2006 the pay will be basic pay including stagnating increment and Rank pay plus the Dearness pay and Dearness allowance drawn at the time of retirement.






As per these orders, for pre-2006 retirees rank pay is included as a part of pay but for post-2006 retirees, the MSP is not reckoned in the pre-retirement pay for the purposes of pay fixation on re-employment. However, for pension purposes the reckonable emoluments are- basic pay + grade pay + MSP + NPA wherever admissible. Therefore, while MSP is not taken into consideration for the purpose of pay fixation on re-employment, the element of MSP in pension is deducted.






It has been decided in consultation with the Department of Expenditure, that since the element of MSP is not reckoned in the pay fixation on re-employment, it need not be reduced from the pension either. Hence, in respect of all those Defence Officers/personnel, whose pension contains an element of MSP that need not be deducted from the pay fixed on re-employment.

ORDER
In continuation of this Department’s order of even number dated 03.02.2010, it has been decided by the Competent Authority in the Department to carve out the number of posts of Postmaster Gr. I, Postmaster Gr.II and Postmaster Gr. III from the existing General Line Cadre posts for various Postal Circles as given in the Annexure.
2. Chief Postmasters General of respective Circles shall accordingly identify the Head Post Offices/Sub Post Offices to the extent of number indicated in the Annexure where the Postmasters of the respective grades in each of the identified offices are to be deployed.
3. As per the information furnished by the Circles, it is anticipated that there would be sufficient number of Higher Selection Grade-I and Lower Selection Grade Head Post Offices/Sub Post offices to identify the Offices for deployment of Postmaster Gr. III and Postmaster Gr. I respectively. While identifying the Offices, preference may be given to Head Post Offices, Mukhya Dak Ghars, Offices identified for Core Banking Solution (CBS), major delivery offices and offices located in prime locations serving as face of India Post. In case of such circles where sufficient number of Head Post Offices/Sub Post Offices of the level of HSG-II is not immediately available for deployment of Postmaster GR.II, the Chief Postmaster General of the concerned Circles may identify major Lower Selection grade Sub Post Offices to deploy them, While identifying LSG Sub Post Offices care may be taken that such offices are identified which are located in prime locations and have the potential to generate more business in future.
4. After the Head Post Offices/Sub Post Offices are identified and notified for deployment of Postmasters, the information regarding name/status of the identified Head Post Offices/Sub Offices should be furnished to the Directorate as per the attached proforma. The Decision once taken by the Chief Postmasters General would be final and no change in future would be permissible without consulting the Directorate.
5. The Posts will be deemed to have been designated as postmaster Gr. I, Postmaster Gr. II and Postmaster Gr. III w.e.f the dated those are filled up.

Subject: Rate of monthly subscription and insurance cover under CGEGIS-1980 for erstwhile Group 'D' employees placed in PB-1, Grade Pay Rs.1800/- and classified as Group 'C'
 
The undersigned is directed to invite the attention of all Ministries/Departments of the Central Government to this Ministry's O.M. No.F.7(5)-EV/89 dated 15th May, 1989 updating the Central Government Employees Group Insurance Scheme, 1980.

  
2. The 6th Central Pay Commission in para 4.9.4. of its report has recommended that the rate of monthly subscription and the amount of insurance cover under the Central Government Employees Group Insurance Scheme (CGEGIS) should be enhanced 6 times. The Commission has also recommended up-gradation of Group D in the Government with all existing Group D employees being upgraded and placed in the entry grade of Group C. Accordingly, no separate slab for Group D has been recommended.
3. In view of the recommendations of 6th CPC, Department of Personnel & Training vide notification dated 9/4/2009 has classified the posts carrying the Grade Pay of 1800/- as Group C.

  
4. Therefore, it has been decided to enhance the monthly subscription towards CGEGIS and insurance coverage to the erstwhile Group 'D' employees placed in PB-1 with Grade Pay of 1800 and classified as Group 'C', @ '30/- per month from 1st January of the next calendar year i.e. January, 2011.

Sub: Hospital recognized by the State Govts./CGHS/CS (MA) Rules, 1944- Grant of permission for treatment in any of the hospitals-regarding.

The undersigned is directed to say that the issue for grant of permission for treatment of Central Govt. employees and the members of their family in any of the hospitals recognized by the State Govt./CGHS Rules/CS(MA) Rules, 1944,had been under consideration of the Govt. for some time past. It has now been decided that the Central Govt. employees and the members of their families may be permitted to avail of medical facilities in any of the Central Govt./State Govts./CS(MA) Rules,1944, as well as the hospitals fully funded by either Central Govt. or the State Govt, subject to the condition that they will be reimbursed the medical expenditure at the rates fixed by the Govt. Under the CGHS Rules/CS(MA) Rules, 1944 or the actual expenditure incurred, whichever is less. In other words, the permission can be granted by the Head of the Ministry /Department/Office to the Central Govt. employees /members of their families to obtain medical services from any of the private hospital recognized under CGHS in the 18 CGHS covered cities also.

2. If the treatment for a particular diseases/procedure is available in the same city where the Govt. servant is employed, he may be permitted to avail of the medical services in any other city of his choice but in such cases, he will not be eligible for sanction of TA/DA. In case the treatment for a particular diseases/ procedure is not available at the same station, the beneficiary will be eligible for sanction of TA of his entitled class for taking treatment in a different city.
3. These orders will be effective from the date of the issue.
 
4. This issues with the concurrence of Finance Division vide their Dy. No.757/2000-JS FA(H) dated 16.2.2000.

CHILD CARE LEAVE CONDITION RELAXES

Sub: Child Care Leave in respect of Central Government employees as a result of Sixth Central Pay Commission recommendations - Clarification regarding






The undersigned is directed to say that this Department has been receiving representations from Government Servants through various quarters like the Public Grievances Cell/Associations etc requesting to review the decision to allow Child Care Leave (CCL) only if the employee has no E.L. at her credit.






2. This Department's O.M. No.13018/2/2008-Estt.(L) dated 11/09/2008 regarding introduction of Child Care Leave in respect of Central Government employees and subsequent clarifications vide O.Ms. dated 29/9/2008, 1811 112008 and 2/12/2008 were reviewed.






It has now been decided in consultation with Department of Expenditure, to delete the condition that CCL can be availed only if the employee concerned has no Earned Leave at her credit, subject to the following conditions:-






(i) CCL may not be granted in more than 3 spells in a calendar year.






(ii) CCL may not be granted for less than 15 days.






(iii) CCL should not ordinarily be granted during the probation period except in case of certain extreme situations where the leave sanctioning authority is fully satisfied about the need of Child Care Leave to the probationer. It may also be ensured that the period for which this leave is sanctioned during probation is minimal.






3. It is reiterated that the leave is to be treated like Earned Leave and sanctioned as such.






4. These orders take effect from 1.9.2008. Earned Leave, if any, availed by women employees before availing CCL subsequent to the issue of the OM 13018/2/2008-Estt. (L) dated 18- 1 1-2008 may be adjusted against CCL, if so requested by the employee.

 IT HAS NOW BEEN  DECIDED TO CONSULTATION WITH DEPARTMENT OF EXPENDITURE. TO  DELETE THE CONDITION THAT  CCL CAN BE AVAIALED ONLY THE EMMPLOYEES CONCERNED HAS NO EARNED LEAVE AT HER CREDIT SUBJCT THE FOLLOWING CONDITION

NEW PENSION SCHEME/DISCHARGE BENIFT SCHEME

DISCHARGE BENEFIT SCHEME (SDBS) FOR THE GRAMIN DAK SEVAKS






The department has today released orders on discharge benefits scheme which is in lieu of pensionary benefits and the existing severance amount scheme.


This scheme is optional for the existing GDS employees and compulsory for those entering into service from 1.1.2011.The GDS who are left with only three years or less service shall not be eligible.






For opted to new scheme, the severance amount @ Rs.1500 per annum for every completed years of service will be added to the accumulated contributions at the time of discharge for annuitization.



Govt shall contribute Rs200/- and no recovery from GDS. The contributions shall be credited to the Trustee bank designated by the PFRDA.






Not eligible during Put off periods, Provisional appointments and substitutes.






On promotion, the accumulations shall be transferred under New Pension Scheme.






On attaining the age of 58,the GDS can withdraw 20% of the accumulations.






At the time of discharge 60% will be paid. 40% shall be invested for purchase a Life Annuity from Insurance Company.






On removal & dismissal no amount will be paid.






Option should be given before 30.9.2010.

GDS SELECTION NEW METHOD

DEPARTMENT ISSUE ORDERS FOR MAINTENANCE OF SELECT PANEL WHILE FINALIZING THE SELECTION OF VARIOUS CATEGORIES OF GRAMIN DAK SEVAKS. ORDERS PLACED AS UNDER.





Sub: Maintenance of select panel while finalizing the selection of various categories of Gramin Dak Sevaks.

I am directed to refer to Directorate letter No. 22.12/2001-GDS dated 17.09.2003 regarding observations of conditions of appointment of Gramin Dak Sevaks.






2. In para 4 of the said letter, it was stated that the sole criterion for selection to the posts of all categories of Gramin Dak Sevaks will henceforth be the merit subject to orders on reservation and fulfilling other eligibility conditions like providing space for Branch Office, taking up residence in the BO village etc.


3. The existing procedure does not provide for maintaining a select panel of candidates and operating a waiting list. In the event of selected candidate's refusal to take up the job, failure to provide accommodation within the given time ,etc the concerned recruiting authorities re-notify the vacancy and start the process afresh which oftenly results in delay and litigations.


4. The Hono`ble Central administrative Tribunal Hyderabad Bench an Original Application No.488/2007 filed by Shri M. Santosh vs Union of India .Replying on the Judgment of Full Bench of Hyderabad Bench in the case of M.Sarojini vs Senior Superintendent of Post Office,Vishakhapatnam in OA No. 1315/2000 dated 12.4.2001 wherein the Full Bench passed the order considering all these facts and circumstances we feel that the Department should prepare a panel even for selection to the posts of ED Agents under the P&T EDA(Conduct and Service) Rules,1964. The size of the panel shall not be disproportionate to number of posts. The validity of the period shall be one year."


5. The judgment of the Full Bench of Hyderabad CAT in OA No. 1315/2009 dated 12.04.2001 and the observations made by the Hon`ble High Court of Andhra Pradesh , the issue of regarding maintenance of a select panel and operating a waiting list for various categories of Gramin Dak Sevaks posts has been examined by the Competent Authority.


6. It has been decided that in all cases of future engagement of all categories Gramin Dak Sevaks including the cases which are currently in process and selections not finalized, a select panel of the candidates may be drawn up based on the sole criterion of merit. The panel should be operated in the event of the following contingencies:


(i) Refusal by the meritorious candidate.


(ii) Resignation by the 1st candidate even after joining within one year.


(ii) Review made by the higher authority within one year.


The select panel will be in the proportion of 5 candidates for one vacancy, ie 1.5. The Select Panel will be valid for one year from the date of finalization and after that it would lose its validity.


7. The contents of this letter may be brought to the notice of all authorities concerning to the recruitment of various categories of Gramin Dak Sevaks for strict compliance.


8. This issues with the approval of the Secretary (Posts).

MEMORANDUM

Subject: Disbursement of pension to the Central Government Pensioners in theState of Kerala for the month of August, 2010 on account of ONAM festival.

In continuation of this Office O.M. of even no. dated 5.8.2010 for disbursement of salary /wages of all Central Government employees in the State of Kerala for the month of August, 2010 on account of "ONAM" festival, the Government have decided that the pension of all Central Government pensioners in the State of Kerala for the month of August, 2010 may also be disbursed by the Banks/PAOs of Civil Ministries/Departments (including Defence, Posts &Telecommunications) on 20th August, 2010.

2. The pension so disbursed are to be treaded as advance payments and will be subject to necessary ,if any, in the subsequent payments from September.

3. Reserve Bank of India is requested to bring these instructions to the notice of the pension paying branches of all Banks located in the State of Kerala for necessary action immediately.

MEMORANDUM

Subject: Disbursement of salary /wages to the Central Government Employees in the State of Kerala for the month of August, 2010 on account of ONAM festival.

In view of the "ONAM" festival the Government have decided that the salary of all Central Government Employees in the State of Kerala for the month of August, 2010 may be drawn and disbursed in the Central Government Offices (including Defence, Posts &Telecommunications) on 20th August, 2010.

2. The wages for August, 2010 of the individual employees of Central Government serving in the State of Kerala may also be disbursed in advance on 20th August, 2010.

3. The salary /wages so disbursed are to be treated as advance payment and will be subject to adjustment after the full months salary/wages of each employee is determined. The adjustment, if any, will be made without exception from the salary /wages as the case may be from the month of September, 2010.

4. The concerned Ministry/Departments are requested to bring these instructions to the notice of their offices located in the State of Kerala for necessary action immediately.
